Refund Request Email to SW

Postby bit1313 » Thu Apr 30, 2009 12:39 pm

I will post this here for all to see. I will also post any response that I receive, just so that all of us that have invested into this company know where we stand.

Email to Andrew and Caroline: 2009/04/30:

Andrew and Caroline,

Due to the current lack of product and communication, I want to officially request a full refund for my 500 Club Membership. I do understand that there are terms to the agreement, however, the terms have NOT been fulfilled by the Sonicwarp said in ANY WAY (no product, no communications, nothing)

I would expect a FULL refund of ALL of my money including credit fees, international fees, administrative fees and exchange rate fees. I have been a "500 Club" member since November and have not seen or heard of a single product that I will be receiving anytime in the near future. Sonicwarp has defaulted on this arrangement and therefore owes me my money in full.

The total US amount I am expecting is $765.11.

I took this to be a serious transaction with serious and firm expectations on both sides, I have provided my payment in full and your company has not even provided a "membership card" or "email of acknowledgment" for all of my money and waiting.

I look forward to a response in a timely manner and please conduct yourselves accordingly.

Sincerely,

Gene Homan

Good Luck, I did get my money back when I asked for a refund on My Ramisis and from my Treasure chest game tokens. Have to said that I'm surprised that it has taken you guys so long.

Puzz I think the "the 500 club" is now critical and damaging SW creditability massively, come on pull something out of "the bag" and quickly.

The competition is alive and well and producing great puzzles at reasonable prices and a super quick turn around. And guess what? They RUN A FORUM! AND THEY ANSWER QUESTIONS AND EMAILS! And... {gasp}... they DELIVER THE PRODUCT THAT YOU PAY FOR!

i am right there with you buddy. CP posts on almost a daily basis and has no problem saying, "hey guys we had a problem. the problem was XXXX, its was fixed yesterday and the result it XXXX." i can totally respect that. when i hear my puzzle is late and you are up front and tell me and the world, i can except that, and i dont mind.

Anyone who wants a refund from the 500 club is entitled to it no matter what SW say. SW is a limited company and so a winding up petition can be issued on the company. Every 500 club member has been dealt with "Unfairly" and this is by law a breach of your consumer rights. The promises the 500 club was supposed to give have not been fulfilled. Any small claims court will see this and judge in your favour. If SW do not pay up the company will be forced to fold. You can also claim compensation but this will not be a high amount. If anyone wishes to do this I can send you the forms, you don't need a solicitor.

Before issuing the petition you have to send a registered letter to the company explaining what you will be doing if you don't receive a full refund in the next 14 days. If no response has been forthcoming then legal action can go ahead.

I have done this a few times on LTD companies who have not paid me for work I have done. Every time the winding up petition lands on their desk I have recieved my full payment without going to court. SW will not let the company fall for a few hundred quid.

Know your rights!

I'm a 500 club member but not yet asking for a refund. I will consider it if I get to a point where I feel enough is enough. If you want to wait until this time I can arrange a multiple claim and the initial cost will be less for issuing the petition. All the costs can be claimed back from SW. for more details see the link below. I feel this post might not last long on the website.

I agreed with matt, this is going the same way as the discussion on NWP, this type of action will hurt all those who take part in the adventure.
If you are not happy with joining the the 500 club and want a refund - play the rest of the adventure, find and open a pyramid, this should keep your minds busy and hopefully line your pockets.

ps can you sell your 500 club membership to others :?: :?: :?:
